Ordinance No. 74
An ordinance granting Amos K. Bass of Caddo, Ind. Ter., his associates or assigns, a franchise to build and operate a system of waterworks in the incorporated town of Caddo.
Be it ordained by the town council of the incorporated town of Caddo:
Sec. 1. That Amos K. Bass, his associates or assigns, are hereby granted the right, privilege and franchise to construct, operate and maintain a complete system of waterworks in the incorporated town of Caddo.
Sec. 2. That for the said purpose the said party or parties are hereby authorized to place under the streets, alleys, and public places of the said town all mains, pipes, and other such apparatus as may be necessary for the construction, maintenance and operation of such system of waterworks provided the free use of any such street, alley, or public place by the public shall not be unnecessarily obstructed, interfered with or impaired.
Sec. 3. That right, privilege, and franchise herein granted Amos K. Bass, his associates, or assigns shall continue for a period of forty (40) years, according to the terms of this franchise and the exclusive use of the streets, alleys and public places for the said purpose and length of time is hereby granted to the said party or parties.
Sec. 4. That actual work of sinking necessary wells to supply water for said system of waterworks shall begin within ninety (90) days from the date hereof and the said system shall be constructed, completed, and in operation without unnecessary delay and within the months from the date hereof. If not then in operation, the right privilege and franchise herein granted may be by the town council deemed and declared forfeited.
Sec. 5. That the pipes, mains, apparatus, etc. used in the construction of the said system shall be modern, safe, and convenient and shall be of sufficient size, etc. to furnish a pressure adequate for fire protection, provided such service is desired and contracted for by the incorporated town of Caddo.
Sec. 6. That the said Amos K. Bass, his associates or assigns shall supply the residents, inhabitants, business or other establishments of every kind and nature, and incorporated town of Caddo within the limits of said town, with water in such form and manner as my be from time to time required, and at such rates as may be agreed upon by the said Amos K. Bass, his associates or assigns and the town council of the incorporated town of Caddo. In the fixing of such rates consideration shall be given to the cost of installing and maintaining said system of waterworks together with rates charged for similar services in like towns under similar circumstances, it being understood that the said town council shall have power and authority to provide the manner and method in which the said rates shall be considered and fixed.
Sec. 7. That the said Amos K. Bass, his associates or assigns shall at all times keep sufficient water in the mains, pipes, and towers to supply the needs of the people and business establishments within the town of Caddo, and furnish sufficient pressure for fire protection.
Sec. 8. That failure on the part of Amos K. Bass, his associates, or assigns, to operate the said system of waterworks in full accordance with the terms hereof for the space of three months shall be deemed a surrender of all rights, privileges, or franchise granted by this ordinance.
Sec. 9. That during the life of this franchise no person or persons other than Amos K. Bass, his associates, or assigns shall lay any pipes or mains for the purpose of maintaining a public waterworks system on any of the streets, alleys, or public places within the incorporated town of Caddo on which the said Amos K. Bass, his associates or assigns have laid such pipes, mains, etc.
Sec. 10. That this ordinance shall be in full force and effect from and after the passage and publication and the filing in the recorder’s office in the town of Caddo by the said Amos K. Bass, his associates, or assigns, his or their acceptance of this franchise, together with a receipt showing payment of the costs of the publication of the ordinance.
